D. Todd Smith has a statewide practice representing clients as lead appellate counsel and working with trial teams in all phases of civil litigation. Over his 25-year legal career, Todd has handled matters in nearly all of Texas’s 14 intermediate appellate courts and has briefed and argued multiple cases before the Texas Supreme Court and the United States Court of Appeals for the Fifth Circuit. In trial courts, Todd takes the lead on strategic analysis and briefing, jury charges, and potentially dispositive motions, all with a focus on preserving error and positioning cases for appellate review. He also testifies as an attorney-fee expert in select cases.

A Fort Worth native and fifth-generation Texan, Todd received his undergraduate degree from Texas Christian University and a master’s in public administration from Texas Tech University. He earned his J.D. cum laude from St. Mary’s University School of Law, where he served as editor-in-chief of the St. Mary’s Law Journal and as an intern to Fifth Circuit Judge Emilio M. Garza (ret.).

Before launching his own firm, Todd spent two years as a briefing attorney to Texas Supreme Court Justice Raul A. Gonzalez (ret.) and practiced for nearly a decade with Fulbright & Jaworski L.L.P. (now Norton Rose Fulbright US LLP). For fifteen years, Todd has been certified as a specialist in Civil Appellate Law by the Texas Board of Legal Specialization, and he has been included on Thomson Reuters’ Texas Super Lawyers list for eight years running.

Todd has a long history of volunteer service to the bar and related organizations. He is chair of the Austin Bar Foundation, and serves on the State Bar of Texas Board of Directors. He is the immediate past-president of the Austin Bar Association, spent three years on the Austin Bar’s Executive Committee, completed two terms on its Board of Directors, and chaired its Civil Appellate Law and Solo/Small Firm Sections. He has also served on the State Bar Appellate Section’s governing council and as editor of its flagship publication, The Appellate Advocate.

Todd is a Life Fellow of both the Austin Bar and Texas Bar Foundations and completed two terms on the St. Mary’s Law Alumni Board of Directors. He is a trustee of the Texas Supreme Court Historical Society and a voting member of the Judicial Committee on Information Technology, which the legislature created to develop standards and guidelines for implementing technology in Texas courts. He also serves on the State Bar’s Standing Committee on Pattern Jury Charges for the Business, Consumer, Insurance, and Employment volume.

Todd is a regular author and speaker on appellate-related topics. Aside from frequent appearances at continuing education programs, he is the creator and publisher of the Texas Appellate Law Blog, the first blog focusing on Texas appellate practice. He is also the creator, producer, and co-host of the Texas Appellate Law Podcast, a weekly show that demystifies appellate law and pulls back the curtain on the appellate system through conversations with judges, court staff, and top trial and appellate practitioners.
